Terms of Use for the Narvi Flow Application

1. SCOPE OF APPLICATION AND ACCEPTANCE OF TERMS

These terms of use (“Terms of Use”) apply to the use of the Narvi Flow mobile application (“Application”). The Application is provided by Narvi Ltd, business ID: 2087049-2, address: Yrittäjäntie 1, 27230 Lappi, FINLAND (“Service Provider”, “we” or “us”).

These Terms of Use constitute an agreement between the person using the Application (“User”) and the Service Provider regarding the use of the Application.

By using the Application, you accept these Terms of Use and other instructions provided separately for the Application and agree to comply with them. The Terms of Use regulate the tasks, rights and obligations of the Service Provider and the User.

If you agree to the Terms of Use on behalf of a company or other legal entity, you warrant that you have the authority to bind that entity to these Terms of Use, in which case the terms “User”, “you” or “your” refer to that entity.

2. PURPOSE OF THE APPLICATION

The Narvi Flow Application is a mobile application that allows the User to remotely control the sauna heater and manage the sauna functions. For example, the application can be used to start the heater, adjust the temperature and control other sauna functions.

The application is intended for personal use. Use of the application requires compatible sauna equipment (a heater manufactured by Narvi and/or a Narvi Flow controller), an internet connection and a mobile device.

3. RIGHT OF USE AND ITS VALIDITY

By accepting the Terms of Use, we grant you a personal, non-exclusive, non-transferable and revocable right to use the Application in accordance with these Terms of Use (“Right of Use”).

The Right of Use is valid until further notice and is linked to the validity of these Terms of Use. You may terminate the Right of Use at any time by deleting the Application from your mobile device.

4. USER ACCOUNT AND REGISTRATION

Users of the Application must be of legal age and have legal capacity. When registering, you must provide accurate and up-to-date information about yourself. Providing false or misleading information may result in the termination of your account. Your user account is personal and may not be transferred or made available to others.

You are responsible for the security of your user account and for all actions taken through your account, as well as for all other actions related to your account. The electronic network environment is not completely secure.

You must notify us immediately if you suspect unauthorised use of your user account or any other security breach. We are not responsible for any negligence regarding the security of your user account or any damage that may result from it.

We may suspend or delete your user account if we believe that you have violated these Terms of Use or that your behaviour or content could damage our reputation or goodwill. If we delete your account for the reasons mentioned above, you may not re-register with the Application.

5. USER OBLIGATIONS

IMPORTANT: The Application enables remote start-up of the sauna heater and control via Mobile. The user undertakes to use this function responsibly and safely.

Before activating the remote control function for the heater, the User must always ensure that:

  • the heater and its immediate surroundings do not contain any flammable or combustible materials (such as towels, clothing, paper or other easily flammable objects)
  • the heater and Narvi Flow controller have been installed in accordance with the installation instructions
  • there are no persons or animals in the sauna room
  • the sauna doors and ventilation are in proper condition
  • the heater is in safe working order and has been serviced as specified by the service provider
  • the Internet connection used by the remote control is working
  • the heater is safe to use in the prevailing conditions

You are solely responsible for ensuring that the remote control of the heater complies with applicable laws, building regulations and safety regulations.

The application can only be used with Narvi Flow controllers.

You are solely responsible for the technical functionality and information security of the devices, software, and communication and data connections you use to operate the Application. You are also responsible for acquiring and maintaining the equipment and connections necessary for using the Application and for ensuring that they do not cause any harm, disturbance or damage to the Service Provider or third parties. To ensure the proper functioning of the Application, you must ensure that you are using the latest version of the Application.

6. PROHIBITED USES

You are only entitled to use the Application for the purposes specified in these Terms of Use.

The Application may not be used to publish or distribute material protected by copyright, trademark or other similar rights without the permission of the rights holder, or in any other way that is harmful, offensive or damaging to the Service Provider, other users or third parties. The user is liable for any misuse and for their actions under both law and contract. We reserve the right to terminate your use of the Application if you violate any of the prohibited uses.

7. USER CONTENT

In order to provide the services of the Application, we collect and compile content or data we receive from you. We may use your content to develop and improve our products and services.

You are solely responsible for all content that you upload or use in connection with the Application. You represent and warrant that you have all rights necessary to upload or use the content.

You are responsible for any damages and costs incurred by the Service Provider as a result of any third-party claims, demands or disputes relating to the content you upload, your use of the Application or intentional misuse.

8. PROCESSING OF PERSONAL DATA AND PRIVACY

By using the Application and accepting these Terms of Use, you consent to the processing of your personal data in accordance with the Privacy Policy and these Terms of Use.

The processing of personal data complies with the EU General Data Protection Regulation (GDPR).

We process the following data:

  • the information you provide when registering (name, contact details, age, email address)
  • device information: heater model, serial number, IP address
  • usage data: settings, temperature adjustments, usage times and app usage
  • location data: only if you enable location-based features
  • app usage data (login times, usage events)

We collect the above information to provide and develop our products and services, as well as to provide customer support and ensure service quality.

The processing of your personal data, data storage, user rights and other data protection issues are described in more detail in a separate privacy policy.

You can check and update your account information in the Application. You can cancel the use of location data at any time. You can also request the deletion of your account and personal data as described in the privacy policy.

9. INTELLECTUAL PROPERTY RIGHTS

“Intellectual property rights” means all present and future rights relating to copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to bring an action for infringement, invention rights, rights of use and all other intellectual property rights, whether registered or unregistered. The rights include the right to seek and obtain protection for the above rights in all applicable jurisdictions and to claim priority for such rights. The provisions on intellectual property rights apply to all existing or current rights anywhere in the world.

These Terms of Use do not transfer to you any intellectual property rights owned by the Service Provider or third parties. All rights, title and interest in such property remain solely with the Service Provider.

All trademarks, service marks, graphics and logos used in the Application are trademarks or registered trademarks of the Service Provider or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Application and Services may be the trademarks of other third parties.

Your use of the Application and Services does not grant you any right or licence to reproduce or otherwise use the intellectual property rights of the operator or third parties.

10. RESPONSIBILITY FOR THE SERVICE

We strive to keep the Application continuously available and to provide it as up-to-date and error-free as possible. However, we do not guarantee that the Application will always be available without interruption or error. The Application may experience service interruptions, usage restrictions, or errors or deficiencies in the Application or its content due to, for example, maintenance work, data transfer problems, or technical problems. We reserve the right to suspend the use of the Application if necessary, for example, due to installation, modification or maintenance work, or if required by law or regulations. We will endeavour to give advance notice of any interruptions in service.

The Application is provided without commitment and “as is”. We do not guarantee the accuracy or reliability of the information presented in or accessible through the Application. We are not liable for any direct or indirect damage caused by the use of the Application and the information contained therein or by its interruption, such as delays, loss of income, goodwill, rights of use or information, or other financial losses.

The Service Provider has not approved or reviewed any third-party websites linked to the Application, and the Service Provider is in no way responsible for their content. The use of websites maintained by third parties is subject to the rules of those websites and platforms.

The Service Provider shall not be liable in any way for any damage caused by your use of the Application in violation of these Terms of Use, instructions or regulations, including the safety instructions described in section 5. The Service Provider is also not liable for any damage caused by the malfunction of your hardware, software or data connections or by force majeure.

The Service Provider’s liability shall be limited to the maximum extent permitted by mandatory law. Under no circumstances shall the Service Provider and its officers, employees, representatives, suppliers or licensors be liable for any indirect damages. Indirect damages include, but are not limited to, damages for lost profits, revenue, sales, goodwill, business interruption, loss of anticipated savings and loss of business opportunities. The limitation of liability applies regardless of the cause of the damage.

11. SERVICE DEVELOPMENT, CHANGES AND INTERRUPTIONS

The Service Provider has the right to develop and update the Application and produce it in the manner it deems best. You must install the updates provided to ensure the proper and secure functioning of the Application.

Disruptions or interruptions in network connections may affect the timeliness and visibility of the Application’s data and content. The Service Provider does not guarantee the uninterrupted or error-free operation of the Application and is not responsible for the availability of the account you have created in the Application.

The Service Provider also has the right to discontinue the provision of the Application entirely or to suspend its operation temporarily. We will endeavour to give reasonable advance notice of any changes that significantly affect the use of the Application.

12. CHANGES TO THE TERMS OF USE

We reserve the right to change these Terms of Use or other terms and conditions related to the Application and its services at any time. We will notify you of any changes to the terms and conditions in the Application. The changes will take effect when they are updated in the Application. By continuing to use the Application after the Terms of Use have been changed, you agree to be bound by the new terms.

If any provision of these Terms of Use is found to be unlawful, invalid or unenforceable by a court of competent jurisdiction, the other provisions or parts thereof shall remain in full force and effect.

13. DISPUTE RESOLUTION

Any disputes arising from these Terms of Use shall be resolved primarily through negotiation. However, the consumer shall always have the right to bring an action before the competent court of consumer’s place of residence. For business customers (B2B customers), disputes shall be resolved in the general court of the Service Provider’s place of residence.

14. ACCEPTANCE OF TERMS

You confirm that you have read these Terms of Use and accept all of their provisions. By using the Application, you agree to comply with these Terms of Use.
